Driving under the influence (DUI) or Drinking with impairment (DWI) is an offense that doesn’t come without legal consequences. The State of Maryland has strict laws implemented for DUI or DWI convictions. Also, the possible legal implications for a DUI or DWI offense must not be taken lightly, as the possible punishments for these offenses could hurt a person and their future badly.

 

What are the penalties for a DUI/DWI in Maryland?

After getting a blood alchohol concentration (BAC) test, and results turn out to be  0.08% and above, a driver can be charged for a DUI offense. The possible punishment for a DUI are as follows:

 

First Offense:

  • A possible jail time of 2 months to 1 year.
  • Fines and penalties up to $1,000.
  • License suspension for a minimum of 6 months.

Second Offense:

  • A possible jail time of not more than 2 years.
  • Fines and penalties of not more than $2,000.
  • License suspension of not more than 1 year.
  • Enrollment in an Ignition Interlock Program could be recommended.

Third Offense:

  • A possible jail time of not more than 3 years.
  • Fines and penalties of not more than $3,000.
  • License suspension for a minimum of 18 months.
  • Enrollment in an Ignition Interlock Program could be recommended.

 

DUI penalties with a MINOR on board

Driving with a minor during the arrest could likely increase the possible penalties of a DUI offense. The possible legal consequences could start from 2 to 4 years of possible jail time; fines and penalties of $2,000 up to $4,000; and a recommendation to enroll to an Alcohol Education Program (AED) or installment of an Ignition Interlock Device (IID).

 

DUI penalties when the driver is a MINOR

            Maryland DUI laws has zero tolerance to DUI offense involving a minor. The law defines a MINOR as someone under the age of 21. As stated in the Maryland Transportation code, if the driver is at least 18 years of age but under the age of 21, the case will be tried in a criminal court just like any other DUI. Otherwise, a driver below 18 years of age will be tried in a juvenile court. All cases involving an under age DUI in Maryland will face suspension or revocation of their driver’s license.
